JUDGE PUTS SOME OF DOT-BIZ OUT OF BIZ
A California judge has ruled that it is likely that dot-biz
registrar Neulevel is running an illegal lottery and thus
issued an order enjoining it from proceeding with certain
aspects of its dot-biz domain allocation.  The judge stopped
53,000 domains for which there were multiple applications
from going live and required NeuLevel to deposit $3 million
with the court to cover the possibility of refunding the $2
application fee NeuLevel collected from the 1.5 million
applications received for those 53,000 domains.

WHILE VIRGINIA COURT DISMISSES NEULEVEL SUIT AGAINST AMAZON
It was all-around bad day for NeuLevel -- an ILN reader
reports that a Virginia court has dismissed the Neulevel
suit launched against Amazon.com.  The court ruled that it
did not have subject matter jurisdiction.  Neulevel brought
the suit after receiving a threatening letter from Amazon
claiming that the company was operating an illegal lottery.

WHAT IS THE VALUE OF A PENDING TRADEMARK APPLICATION UNDER
THE UDRP?
Apparently it depends on whether you are a complainant or
respondent.  In a just-released NAF decision involving
"channel5.com", a three-member panel, which included Carolyn
Marks Johnson, ruled that the respondent's pending trademark
application did not establish a legitimate interest in the
name, noting that "a trademark filing, in and of itself,
does not constitute sufficient demonstrable preparations to
use a domain name in connection with a bona fide offering of
goods and services."  Interestingly, the same panelist, the
NAF's second busiest, has consistently ruled that a
complainant's pending trademark application does offer
evidence of a right in the name ("Complainant's rights are
evidenced by its pending trademark application with the
United States Patent and Trademark Office for TELEPLACE.";
"Complainant also has rights in the mark, given
Complainant's pending trademark application.").
