That is not actually true.  It is theoretically possible for someone to
register a name at the precise instant that the name is deleted from the
database.  ie the process is not a transfer process, it is a delete and
re-apply process.

It is possible to change the domain name contact details of a domain name
after the sale of a business that uses the domain name - see below:

"Section 4.2 of the Policy and Section 12 of the Terms and Conditions
prevent the sale of a licence to another entity. However if the entity
holding the licence is sold then the licence is also sold and remains with
the entity. For example in the case of a company selling a registered
business the AUNIC WHOIS record can be edited to show the new owner of the
business but only if the registered business number has not changed. A
request to edit the registry should be sent to Melbourne IT on letterhead
with documentation to verify the new owner details. If a company is sold
then only the address and contract details need to be updated and this can
be done by the new licence holder."
