David Beckham has breathed new life into the internet, with
his move to Real Madrid sparking a flurry of online
activity. Within hours of Beckham signing for the Spanish

The German Federal Supreme Court held that a pseudonym
registered as a domain name may also constitute an
infringement of one’s right to one’s name. The Court
decided that, although a pseudonym also acquires protection
under the name right, such protection is only enforceable
where the user is known under that name.

Cybersquatting and Misspelled Domain Names - from Baker &

The Complaint Board for Domain Names recently decided two
cases in which a business had registered misspelled domain
names of two well-known company web sites, i.e.
"wwwnykredit.dk", "www-nykredit.dk" and "nukkredit.dk"
rather than "nykredit.dk". Nykredit is a major Danish
financial institution. The registrations in question were
only a few out of more than 400 registrations. The
Complaint Board found that the registrations not only
constituted an infringement of the well-known trademarks,
but were also a breach of good marketing practices. The
board found that the registrations should be transferred to
the complainants.

Holocaust Copy Web Site - from Baker & McKenzie Global
E-Law Alert
The Complaint Board for Domain Names has decided a case
regarding the two web sites "holocaust-uddannelse.dk" and
"holocaustuddannelse.dk". "Holocaust-uddannelse" translates
to "Holocaust-education". The former web site was launched
in 2001 by a publicly funded but independent institution
studying historic and current events relating to genocide.
The latter web site was launched in 2002 by an organization
denying the occurrence of the Holocaust. The Complaint
Board found that both the domain name and the content of
the latter web site were clearly copying the original web
site and thus ordered "holocaustuddannelse.dk" transferred
to the complainant. The board found that the actions were
in breach of honest conduct, citing the principles on good
marketing practices.
