I would have thought that it was just like the relationship between an
insurance broker
and the insured where (broadly speaking) the broker acts and is treated as
though
they were the insured.

That is a load of crap if the broker acts for the insured..theinsured is
allways listed on the insurance documents as the insured what a stupid
comparision.

Well it may but what about the case where the registrant choses to use an
agent?
There are plenty of solicitors (IP specialists and others), accountants and
others who
put their contact details on .au domain records.

If a domain registrant says to any person I want you to be my agent in this
regard
then so long as the agent passes on relevant information to the principal
and acts in
ways to benefit the principal then that should be of no concern to anyone
other than
the two parties to the agency.

The way around this spam issue would be for registrars o be obliged to offer
an opt
in/opt out button for superfluous "special offer" mailings.
