Jefferson Rebuffed - The United States and the Future
of Internet Governance by Viktor Mayer-Schoenberger
and Malte Ziewitz
In Part I we briefly recount the current structure of
naming and numbering governance on the Internet
through ICANN. In Part II we describe the main
elements of the European proposal. Part III analyzes
why and to what extent the proposal would have enabled
a unique ?constitutional moment? for Internet
governance. Part IV explores why the proposal failed
to persuade the United States government despite its
own constitutional history. Examining four sets of
potential reasons ? federalism, individual rights,
public choice, and international law ? we find that a
combination of differently aligned economic interests
and a reluctance to delegate even self-constrained
power to an international regime explains why 2005
will not be remembered as the Internet?s 1789.

Domain Tasting Target of US Federal Cybersquatting
Lawsuit By Ram Mohan
So Domain Tasting, where registrants (who may also be
registrars) taste names and keep only those that have
economic value, is now the target of a federal
cybersquatting lawsuit, brought about by lawyers for
major brand name retailers Neiman Marcus and Bergdorf
Goodman against major domain name registrar Dotster.
This Dotster lawsuit involves allegations of
cybersquatting by registrars who use the Create Grace
Period, which is mandated by ICANN for global
registries.

(ccTLD) manager DENIC. This marks the mutual
