I suspect James is wondering if whois data is a 'public document'. If
so, then the ACN is required.

"A company's ACN should appear on all of its 'public documents' and
'eligible negotiable instruments'". Taken from

If I'm not mistaken all this grandfathered data will be cleaned up at or
around the second anniversary of the competitive registrar system.
