GOVERNANCE

**********************

Does the Internet Need "Governance"? by David P. Reed

It's remarkable to me that there are now two powerful agencies fighting to "govern" the Internet -- the ITU and the FCC. On any given day, it's hard to tell whether they are on the same side or different sides. The ITU process apparently began in earnest with the World Summit for the Information Society (WSIS) meetings, where the concept of "Internet Governance" became an urgent goal. The FCC process began when incumbent Internet Access Providers (IAPs) argued that "Net Neutrality" was a stalking horse for government control.

Why global Internet governance must matter to social justice activists

What does the way the Internet is run have to do with development or social justice? Isn?t it just for technical specialists, making sure everything works properly? Well no, actually.

Why We Don't "Stick to Our Knitting": auDA's Role in the Internet Governance Landscape by Paul Szyndler

Last Friday, following three weeks of dazzling diplomacy, the ITU's 2014 Plenipotentiary Conference came to a conclusion in Busan, South Korea. For those unfamiliar with the event, the "Plenipot" is the ITU's most significant gathering... At the Plenipot, ITU members elect new office-bearers, set general policies and determine the Union's strategic plans and activities for the next four years. It is this last part that is of most interest to stakeholders in the Internet community.

In Quashing .IR Attachment Order Against ICANN DC District Court Declares That ccTLDs Are Akin to Second Level Domains by Philip Corwin

On November 10th the US District Court for the District of Columbia granted ICANN?s motion to quash a writ of attachment and a related motion for further discovery in a politically charged case in which private plaintiffs sought to seize control of Iran?s .IR ccTLD. The litigation was brought under a US law that allows victims of terrorism and their families to seize the assets of foreign nations that funded the related terrorist acts. While most of the plaintiffs were targeting Iran the decision also covered the ccTLDs for Syria and North Korea.

Judge: Terror bomb victims CAN'T seize Iran's domain name as compensation

A judge in Washington DC has ruled that a country's entire internet registry cannot be seized, averting a global diplomatic crisis.

Judge blocks seizure of Iran?s ccTLD

ICANN has won a court battle, and avoided a major political incident, over an attempt by terrorism victims to seize ccTLDs belonging to Iran, Korea and Syria.

ccTLDs Might Be Property by Nigel Roberts

The long-running saga of victims who are pursuing 'state sponsors of terrorism' via ICANN has taken yet another turn. Some time back the Plaintiffs in Rubin & ors -v- Islamic Republic of Iran & ors managed to obtain Writs of Attachment in the Federal court district in Washington (D.C.) courts ordering that the ccTLDs of those respective countries be seized in part-payment of the damages they are owed. ICANN, fairly predictably, became involved at this point.

Judge sides with ICANN: Plaintiffs can?t take all of Iran?s domain names

A federal judge in Washington, DC, has ruled that an entire ccTLDs cannot be transferred as part of a civil judgement to collect Iranian state assets in the wake of a terrorism attack "because they are not property subject to attachment under District of Columbia law."

< <http://arstechnica.com/tech-policy/2014/11/judge-sides-with-icann-plaintiffs-cant-take-all-of-irans-domain-names/> http://arstechnica.com/tech-policy/2014/11/judge-sides-with-icann-plaintiffs-cant-take-all-of-irans-domain-names/>

The .IR, .KP and .SY Domains Are ?Safe? by Paul Rosenzweig

A couple of months ago, I noted an interesting law suit brought by several victims of terrorist attacks. They had secured default money judgments against Iran, North Korea and Syria for those country?s alleged complicity in supporting terror and their own resulting injuries. Sadly, for the victims, none of these countries had assets subject to American jurisdiction that could be attached to satisfy the judgments they had secured.

When Worlds Collide: Name Collision Within the New gTLD System and Its Effects on Brand Owners and End Users by Lori Schulman, Jannik Skou & Judy McCool

Imagine that you are a member of a private network. To get your company?s archived documents, you type ?mycompany.mail? into your browser and instead of reaching secured files, you are directed to a public website selling email storage space. Welcome to the world of name collision, where private and public uses of the domain name system (DNS) collide. Simply defined, name collision results when strings used in private networks are identical to strings used in the public name space. Name collision is not new to the gTLD program, but the concern is that as the number of these domains increases exponentially, so will the possibility for unintended misdirection. Of the 1,409 new gTLDs under consideration, nearly 400 have been delegated.

< <http://www.inta.org/INTABulletin/Pages/WhenWorldsCollideNameCollisionWithintheNewgTLDSystemandItsEffectsonBrandOwnersandEndUsers.aspx> http://www.inta.org/INTABulletin/Pages/WhenWorldsCollideNameCollisionWithintheNewgTLDSystemandItsEffectsonBrandOwnersandEndUsers.aspx>

The internet is full of sex, drugs and rock ?n? roll

The new gTLD program is now a year old and registration numbers have broken through the 3 million mark, growing month on month by around 25%. Impressive stuff, considering that the existing gTLD base is growing less than 10%. But that isn?t too surprising as the namespace for .com in particular is very crowded with over 95% of available 4 digit domain names already registered.

New .WINE and .VIN Are Now Political Tools by Jean Guillon

The more I follow the .WINE & .VIN opera, the more I start to believe that the idea is either to kill both new gTLD applications to free space in Round 2 of the ICANN new gTLD program or make this subject a political tool "only" to increase Europe's presence in ICANN decisions. If there still is a wish from the European Commission to help .WINE and .VIN to become the strongest identity European wines could ever have on Internet, I would like to understand why the situation is still blocked.

DNSSEC signing your domain with BIND inline signing

With BIND 9.9, ISC introduced a new inline signing option for BIND 9. In earlier versions of BIND, you had to use the dnssec-signzone utility to sign your zone. With inline signing, however, BIND refreshes your signatures automatically, while you can still work on the unsigned zone file to make your changes.

us: How Congress can shut the door to cyberthreats

Six years ago, the federal government?s classified computer networks were infiltrated by a tiny bit of malware. The government has put cyberthreats at the top of its national security threat matrix.

As anyone who regularly reads this blog has heard me say, there are a surprising number of brand owners and lawyers who have no clue as to how the UDRP operates and the purpose for which it was created. Domain Name Abuse Is a 4 Letter Word

There has been a lot of back and forth recently in the ICANN world on what constitutes domain abuse; how it should be identified and reported AND how it should be addressed. On one side of the camp, we have people advocating for taking down a domain that has any hint of misbehaviour about it, and on the other side we have those that still feel Registries and Registrars have no responsibility towards a clean domain space. (Although that side of the camp is in steady decline and moving toward the middle ground).

Sending Liability Up The Stack: Domain Registrars Potentially Liable For Infringement By End Users

For quite some time now, we've been concerned about the continued expansion of "secondary liability" concepts, adding more and more liability for copyright infringement to parties who are often far removed from any actual infringement. There are two major concerns with this. First, putting liability on one party for the actions of another just seems generally problematic. But, perhaps more importantly, when you put potential liability on an unrelated party, the end result is almost always excessive policing in a manner that hinders or entirely blocks perfectly legitimate activity and speech.

The Role of Data in Promoting Growth and Well-Being

Data forms a key pillar in 21st century sources of growth. The confluence of several trends, including the increasing migration of socio-economic activities to the Internet and the decline in the cost of data collection, storage and processing, are leading to the generation and use of huge volumes of data ? commonly referred to as ?big data?. These large data sets are becoming a core asset in the economy, fostering new industries, processes and products and creating significant competitive advantages.

OECD Technology Foresight Forum 2014 - The Internet of Things

The Internet of Things (IoT), also known as the Internet of Everything or the Industrial Internet, is a term applied to the next 50 billion machines and devices that will go online in the coming two decades. These developments may be thought of as being analogous to the state of cellular mobile services in 1994 ? a time at which it would have been challenging to anticipate all the changes that have followed in the past two decades.
