CANADIAN COURTS STRUGGLE WITH DOMAIN NAMES
My latest Globe and Mail cyberlaw column highlights two
recent Ontario domain name cases that suggest that the
courts are still struggling with certain domain name
concepts. In one case involving iTravel.ca, the judge
granted an injunction out of concern that the domain might
be transferred outside Canadian jurisdiction, something not
permitted by dot-ca rules. In an unreported case involving
expressvu.org, the judge "expressed the view" that ownership
of the dot-com version of the domain should have alleviated
the trademark owners concerns.

The FTC has issued a consumer warning against registering
domains outside of the ICANN-approved list. The FTC says
that domains with unapproved extensions are not readily
found in routine Internet searches nor can be email be
directed to those sites.

Commerce Department arguing that the ICANN - Verisign deal
would be anticompetitive and that the process used by ICANN
