But what if your business is to refer people to a service or product, or to
help them find what they're looking for, and the domain name is simply a
tool in achieving that?  Is that any less of a legitimate use of a name?

You don't have to be Einstein to understand that the measure of "close and
substantial" (and the other eligibility clauses) is so subjective that even
just the tiniest bit of plausibility satisfies the criteria.

Another fact is that generics have a distinct advantage in that they are
less likely to infringe an existing trademark.

Why don't you all just hurry up and register the last remaining generics,
then this futile argument can end.
