I am not saying this in relation to you but I have noticed a growing trend that some people are calling anything they dont like spam. from unwanted messages in a mailling list to anything even remotely commercial. the notice is a required contact based on a pre-existing commercial retail transaction that serves an additional marketing purpose. having said all that I agree with you an opt-in/opt-out is something that will be put in place.
